Ministers to assume responsibility for issued documents

HCMC – Ministers and heads of ministerial agencies will bear the responsibility for the quality of legislation projects and draft legal documents they release or submit for approval, according to a new government resolution.

These submissions must strictly adhere to procedures, timelines and formats, as dictated by the Law on Promulgation of Legal Documents and the Government’s Working Regulations outlined in Decree 39/2022.

Furthermore, these legislation projects and draft legal documents must be accompanied by comprehensive explanatory contents, specifying regulations retained from existing laws while proposing the elimination or revision of regulations no longer aligned with the Government’s direction, policies, or practical implementation.

These explanatory contents require an in-depth analysis of political and legal foundations, along with practical aspects related to the inheritance, revision, and supplementation of specific provisions within draft laws and other legal documents.

A clear delineation of modifications, accompanied by their rationale, is also necessary, alongside a presentation of newly introduced or reduced administrative procedures compared to current legislation.

Resolution 135, issued on August 30, centers on the Prime Minister’s conclusions from the law-making session held on August 24.

The Government has convened seven specialized law-building sessions during the first eight months of the year. These sessions have yielded 12 legislative proposals, 14 draft laws, and 9 draft resolutions slated for consideration by the National Assembly throughout 2023 and 2024.
